Cavalry Inc., (“Cavalry,” “we,” “us,” or “our”), operates the Cavalry AI Interviewer platform (the “Platform”), including our websites and associated domains at www.cavalry.ai (collectively, the “Sites”), and our AI-powered interview tools and related services (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you access or use the Platform or Services. By using the Platform, you consent to the practices described in this policy. If you do not agree, please do not use the Services.

1. Definitions

  1. Company: A business or organization that subscribes to the Platform to assess candidates for open job positions using the Services.

  2. Candidate: An individual who participates in AI-powered interviews conducted by a Company via the Platform.

  3. User: Any individual or entity accessing the Platform, including Companies and Candidates.

  4. Personal Information: Any information that identifies or can be used to identify an individual, such as name, email address, or AI interview data.

2. Information We Collect.

We collect the following types of information:

  1. Information You Provide

    1. Company Information: When a Company registers for an account or purchases a Subscription, we collect details such as company name, billing address, contact name, email address, phone number, and payment information (processed securely via Stripe).

    2. Candidate Information: When a Candidate participates in an AI interview, we collect details such as name, email address, resume, and AI interview responses (including transcripts and related data).

    3. Communications: Information you provide when you contact us via email, support forms, or other channels, such as your name, email address, and message content.

  2. Information Collected Automatically

    1. Usage Data: We collect data about your interactions with the Platform, such as IP address, browser type, device information, pages visited, and timestamps.

    2. AI Interview Data: For Candidates, we collect audio, video (if applicable), and text data from AI interviews, including transcripts and analytics generated by our AI tools.

    3. Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to enhance your experience, analyze usage, and deliver personalized content. See Section 8 (Cookies and Tracking Technologies) for details.

  3. Information from Third Parties

    1. Payment Processors: We receive limited payment-related information (e.g., transaction confirmations) from Stripe, our payment processor, to process Company Subscriptions and Credit purchases.

    2. Analytics Providers: We may receive aggregated or anonymized data from third-party analytics services (e.g., Google Analytics) to understand Platform usage.

3. How We Use Your Information.

We use your information to:

  1. Provide the Services: Enable Companies to conduct AI interviews, store and access AI interview data, and manage Subscriptions. Allow Candidates to participate in interviews and access their account (if applicable).

  2. Process Payments: Facilitate Subscription and Credit purchases for Companies via Stripe.

  3. Improve the Platform: Analyze usage data and AI interview performance to enhance our Services, AI algorithms, and user experience.

  4. Communicate with You: Respond to inquiries, provide support, and send transactional emails (e.g., Subscription confirmations or account updates).

  5. Comply with Legal Obligations: Meet regulatory requirements, enforce our Terms of Service, and protect the Platform and Users.

  6. Marketing and Analytics: Use anonymized or aggregated data to analyze trends, improve advertising, and promote the Services (Companies may opt out of marketing communications).

4. How We Share Your Information.

We do not sell your Personal Information. We may share your information as follows:

  1. With Companies (for Candidates): AI interview data (e.g., responses, transcripts) is shared exclusively with the Company that initiated the interview. This data is not made public.

  2. With Service Providers: We share information with trusted third-party providers (e.g., Stripe for payments, cloud storage providers, analytics tools) to operate the Platform, process payments, and analyze usage. These providers are contractually obligated to protect your information.

  3. For Legal Purposes: We may disclose information to comply with applicable laws, respond to legal processes (e.g., subpoenas), or protect our rights, property, or safety, or that of our Users.

  4. Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred to a successor entity, subject to equivalent privacy protections.

  5. With Your Consent: We may share information with third parties if you explicitly consent to such sharing.

5. Data Retention

  1. Company Data: We retain Company account and billing information for as long as the Subscription is active and as required for legal, tax, or accounting purposes (typically seven years after account closure).

  2. Candidate Data: AI interview data is retained for the Company’s use as long as their Subscription is active. We may retain Candidate data for up to three (3) months after an interview to ensure service continuity, after which we may use it for outreach (see Section 3) or retain it as required by law.

  3. Deidentified Data: We may retain anonymized or aggregated data indefinitely for analytics and improvement purposes.

6. Your Rights and Choices

  1. Access and Correction: Companies and Candidates may access and update their account information through the Platform or by contacting us. Candidates may request corrections to inaccurate data.

  2. Data Deletion: You may request deletion of your Personal Information by emailing support@cavalryhr.com, subject to our legal obligations to retain certain data (e.g., for compliance or record-keeping).

  3. Opt-Out of Marketing: Companies may opt out of marketing emails by clicking the “unsubscribe” link in our emails or contacting us. Candidates may opt out of job outreach communications after the three-month period.

  4. Do Not Track: We do not currently respond to “Do Not Track” browser signals, as there is no universal standard for such signals.

  5. California Privacy Rights: If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), including the right to know, access, delete, and opt out of the sale of your Personal Information (we do not sell your information).   6. GDPR Rights: If you are in the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, erase, restrict, or object to the processing of your data, and the right to data portability. 7. Data Security.

We implement reasonable administrative, technical, and physical safeguards to protect your Personal Information, such as encryption, secure servers, and access controls. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and using secure passwords.

8. Cookies and Tracking Technologies.

We use cookies and similar technologies (e.g., web beacons, pixels) to:

  1. Essential Functions: Enable core Platform functionality, such as authentication and session management.

  2. Performance and Analytics: Track usage patterns and improve the Platform (e.g., via Google Analytics).

  3. Personalization: Customize your experience, such as remembering your preferences. You can manage cookie preferences through your browser settings, but disabling essential cookies may affect Platform functionality. For more details, please review our Cookie Notice (available on our Sites).

9. International Data.

Cavalry is based in the United States, you may not use the service outside of the United States.

10. Children’s Privacy.

The Platform is not intended for individuals under 18 years old. We do not knowingly collect Personal Information from children under 18. If we learn that we have collected such information, we will delete it promptly. Contact us if you believe we have inadvertently collected data from a minor.

11. Third-Party Links.

The Platform may contain links to third-party websites or services (e.g., Stripe for payments). We are not responsible for the privacy practices or content of these third parties. Review their privacy policies before providing information.

12. Changes to This Privacy Policy.

We may update this Privacy Policy to reflect changes in our practices or legal requirements. We will notify you of material changes via email or through the Platform at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the updated policy.
